Jestem za "ACTA 2.0" - Artura Kurasińskiego Newsletter

The Times They Are A Changin'

Pamiętam moje zdziwienie jak niesamowicie dziwnie wyglądała rzeczywistość mediów w filmie "Post" - wydawca powoływał się na dobre imię gazety. Istniała hierarchia wartości. Dziennikarz był niesamowicie pożądanym zawodem. Prasa rozliczała rządzących i brała na siebie funkcję edukacyjną. To wszystko jest przeszłością. 

Kilka dekad temu jeśli chciałeś dowiedzieć się czegoś o świecie albo swojej małej społeczności kupowałeś gazetę. W niej były informacje o tym co się wydarzyło w Ameryce i jaki nowy sklep otworzył się na rogu twojej ulicy. Były też reklamy salonu fryzjerskiego i ogłoszenia. I biznes się kręcił. 

Ludzie szukali informacji więc kupowali gazety. Albo słuchali radia i oglądali telewizję. A potem pojawił się Internet. Na początku nieporadny i mało wydajny szybko przeszedł do ataku. Wraz z rozwojem technologicznym (urządzenia, przepustowość itd) okazało się, że poszukując numeru telefonu najbliższego fryzjera prościej jest to znaleźć za pomocą komputera niż szukać w książce telefonicznej. I tak umarło wiele biznesów.

Można wzruszyć ramionami i powiedzieć "a co to mnie obchodzi. widocznie nie byli zbyt konkurencyjni i zostali wyparci z rynku. mamy kapitalizm!". To prawda. "Stare media" zostały albo zagonione do rogu i wymuszono na nich zmianę (m.in.: przejście z modelu opłaty per sprzedany egzemplarz na model subskrypcyjny) albo próbowały stawać do gry z młodym firmami "internetowymi" - mając przewagę doświadczenia rynkowego i zapasów finansowych kupowały mniejsze firmy, zbroiły się i zajmowały miejsca na rynkowej szachownicy.

AD 2018 obraz wygląda tak: mamy niesamowicie potężnych, globalnych czempionów, którzy kontrolują całość internetu i zmonopolizowały go w swoich branżach (Google = wyszukiwarka online. Amazon = e-commerce. Facebook = media społecznościowe itd) oraz takie podmioty jak gazety czy twórcy utrzymujący się z tworzenia i sprzedaży swojej własności intelektualnej. Walka pojedynczej gazety typu "Piszanin.pl" z Facebookiem czy Googlem jest skazana z góry na porażkę. Tylko, że Facebook czy Google sami nigdy nie stworzą redakcji w Piszu żeby pisać o nowym zastępcy komendanta. 

Z drugiej strony jeśli lokalny periodyk chce dotrzeć do odbiorców oprócz wersji papierowej musi posiadać wersję elektroniczną. I tutaj zaczyna się problem - Google zindeksuje treść i udostępni bez reklam Piszanin.pl ale ładnie wrzuci tam swoje, ktoś na Facebooku zamieści linka dzięki czemu inny użytkownicy zobaczą tytuł, zdjęcie oraz krótki wstęp - i być może nie przeczytają nic dalej. A kilka innych "platform newsowych" wykorzysta treść stworzoną przez mały, lokalny portal w celu wzbogacenia swojej archiwum treści.

Efektem jest upadek prasy a co za tym idzie brak środków na wynagrodzenia dla dziennikarzy patrzących władzy na ręce. Chcemy mieć dobrych dziennikarzy? Ktoś im musi zapłacić. Redakcje okradane ze swoich najcenniejszych skarbów jakimi są ich materiały nie maja na to środków. Spada czytelnictwo, budżety reklamowe przesuwane są online. To wszystko osłabia demokrację i nasze możliwości poznawania faktów. 

I takie przykłady można mnożyć - bo to nie tylko dotyczy małych gazet. Twórcy i media w starciu z globalnymi molochami nie mają szans. Bez ich pracy nie jest możliwe kontrolowanie jak i gdzie ktoś wykorzystuje ich prac nie płacąc im za to.

Teraz zamknij proszę oczy i przypomnij sobie co dokładnie wiesz o tej dyrektywie? Że Unia każe płacić za linki. Że to ACTA 2.0. Że będzie cenzura internetu. Że zakażą memów! 

To wszystko są opisy i emocjonalne dodatki do dwóch artykułów 11 i 13. W dużym skrócie: Unia chce nałożyć na takie serwisy jak YouTube czy Facebook obowiązek monitorowania treści pod kątem tego, czy nie łamią prawa autorskiego. Innymi słowy czyni je odpowiedzialnymi za to co zamieszczają. 

Oraz jeśli chodzi o prawo autorskie ustawodawcy chcą poszerzyć katalog podmiotów korzystających z niektórych uprawnień prawa autorskiego o wydawców prasy. Tyle.

Tymczasem w polskim internecie (a dokładnie na YouTube) zaroiło się od filmików związanych z "odbieraniem wolności", przeinaczaniem faktów i po prostu kłamstwami. Ciężko nie wyczuć lobbingu amerykańskich firm (w końcu to one dostaną po nosie najbardziej). Szkoda tylko, że jutjuberzy zaczynają kręcić filmiki kiedy ich tyłek jest przypalany a nie wtedy kiedy mogą wykorzystać swoje zasięgi do czegoś pożyteczniejszego (#WolneSądy? #MeToo? #CzarnyPoniedziałek?)

Co się stanie z tą dyrektywą finałowo nie wiem. Mam natomiast wrażenie, że idąc w stronę oddania wszystkiego - reklamy online czy monopolizacji kanałów komunikacji sami sobie narzucamy największą cenzurę.

Jestem za zmianą prawa. Oczywiście boję się wypaczeń i pokładam słabe zaufanie do polityków ale tym razem uważam, że ochrona własności intelektualnej ma priorytet. Dość czapkowania przed monopolistami.
